End-User License Agreement

1. Agreement to Terms

This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a business entity) and Field Harmony for the Field Harmony service management software and related services ("Software"). By accessing or using the Software, you agree to be bound by the terms of this EULA.

2. License Grant

Subject to your compliance with this EULA and payment of applicable fees, Field Harmony grants you a limited, non-exclusive, non-transferable license to:

  • Access and use the Software for your business operations
  • Store and manage your business data within the Software
  • Allow your authorized employees and contractors to access the Software

3. Your Responsibilities

You agree to:

  • Maintain the security of your account credentials
  • Use the Software in compliance with applicable laws and regulations
  • Not share your account access with unauthorized parties
  • Not attempt to reverse engineer, decompile, or modify the Software
  • Not use the Software for any unlawful or harmful purposes

4. Data and Privacy

You retain all rights to the data you store in the Software. Field Harmony will process your data in accordance with our Privacy Policy. We use industry-standard security measures to protect your data, but you are responsible for maintaining backups of your critical business information.

5. Payment and Subscription

Access to the Software requires payment of subscription fees. Fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees due. If payment fails, we reserve the right to suspend access to your account until payment is received.

6. Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate your access if you violate this EULA. Upon termination, you will have 30 days to export your data before it is permanently deleted from our systems.

7. Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED. WHILE WE STRIVE TO PROVIDE RELIABLE SERVICE, WE CANNOT GUARANTEE 100% UPTIME.

8. Limitation of Liability

FIELD HARMONY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRIOR TO THE CLAIM.

9. Support

We provide email support to all active subscribers. While we aim to respond promptly, support is provided on a best-effort basis. Critical issues will be prioritized.

10. Updates and Modifications

We may update the Software and this EULA from time to time. We will notify you of material changes via email or through the Software. Continued use of the Software after such changes constitutes acceptance of the updated terms.

11. Governing Law

This EULA is governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Texas.
